These Terms of Service ("Terms") govern your access to and use of BrightLink, operated by BrightLink (ABN 85 187 609 642) ("BrightLink", "we", "us"), available at www.brightlink.com.au (the "Service"). By creating an account or using the Service you agree to these Terms.
1. The Service
BrightLink provides booking and scheduling software for independent service providers. We do not provide the underlying beauty or personal-care services, and we are not a party to any booking or arrangement between you and your clients.
2. Accounts & eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorised use.
3. Acceptable use
You agree not to:
- use the Service for any unlawful, harmful, or fraudulent purpose;
- attempt to probe, scan, or breach the security of the Service or other tenants' data;
- upload malware or attempt to inject or execute unauthorised code;
- resell or sublicense the Service without our written consent.
4. Subscriptions, trials & billing
Paid plans are billed monthly in advance in AUD. Free trials, where offered, require no payment card and convert to a paid plan only if you choose to subscribe. You may cancel at any time; cancellation takes effect at the end of the current billing period. Payments are processed by our third-party payment processor; we do not store full card details.
5. Your data & your clients
You retain ownership of the business and client data you put into the Service. We claim no ownership of it. You may export your client list at any time. You are responsible for having a lawful basis to collect and use your clients' information and for your own privacy obligations to them.
6. Intellectual property
The Service, including its software, design, and branding, is owned by BrightLink and protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service per these Terms.
7. Disclaimers & liability
The Service is provided "as is". To the maximum extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law, our liability arising out of or relating to the Service is limited to the fees you paid us in the three months preceding the claim. [CONFIRM: liability cap amount/period with legal counsel]
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination you may export your data for a reasonable period, after which it may be deleted.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. [CONFIRM: governing-law state/jurisdiction]
